Terms of Service
These terms apply when you create an account on delivered.photos ("the service", "we"). By signing up you agree to them. If you disagree, don't use the service.
The service
delivered.photos is a client proofing platform for photographers. You upload photos, configure a gallery, and share it with your clients. They can view, favorite, comment, and (if you allow it) download.
Your account
- You must be at least 18 years old to create an account.
- You're responsible for keeping your sign-in credentials secure.
- One account per studio. Team seats are part of the Studio plan.
- We may suspend or terminate accounts that violate these terms.
Your content
You retain full ownership of every photograph you upload. We don't claim copyright, we don't license your photos to third parties, and we don't use them to train AI models.
You grant us a narrow, revocable license to host, serve, transcode, and deliver your photos for the purpose of running the service. This license ends when you delete the content (or your account).
You're responsible for having the right to upload and share the content. If you photograph people, you confirm you have the model releases and consents your jurisdiction requires for commercial delivery.
Acceptable use
You will not:
- Upload content you don't have the right to share.
- Upload illegal content, including child sexual abuse material — we'll report it to authorities and terminate your account.
- Use the service to harass, defame, or stalk anyone.
- Resell, sublicense, or whitelabel the service beyond what your plan permits.
- Probe, scan, or attempt to overwhelm the service.
Photographer-client relationship
You are the relationship of record with your clients. We're not a party to your shoot contract, your invoicing, or your delivery agreements. If a client has a complaint about a shoot or a charge you billed them, that's between you and them.
When clients use a gallery you shared, you are the data controller for their personal data and we are your data processor. See the Privacy Policy for details.
Billing
- Paid plans are billed via Dodo Payments in EUR, monthly or annually.
- Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current period.
- We don't offer refunds for partial periods, except where required by law.
- If a payment fails, we'll retry and notify you. After repeated failures the account moves to a read-only state until payment is restored.
Service availability
We aim for high availability but don't promise a specific uptime number. We may take the service down for maintenance with reasonable notice. The service is provided "as is" — we don't warrant that it will be uninterrupted, error-free, or fit for any particular purpose.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability for fraud, gross negligence, or anything else that can't be limited by law in your jurisdiction.
Termination
You can cancel your subscription at any time from your settings. When you cancel, paid features end at the end of the current billing period. Deleting your account removes your data within 90 days, except where we are required to retain it (e.g. billing records).
We can terminate accounts that violate these terms. Egregious violations (CSAM, fraud, security attacks) get immediate termination without refund.
Changes to these terms
When we change these terms in a way that materially affects you, we'll email account holders at least 30 days before the change takes effect. Continued use after the effective date counts as acceptance.
Governing law
These terms are governed by the laws of Portugal, excluding its conflict-of-laws rules. Disputes go to the courts of Lisbon, Portugal, unless a mandatory consumer protection law in your jurisdiction says otherwise.
